App: Dayly — Daily Planner & Habits

1. Acceptance of Terms
By downloading, installing, accessing, or using the Dayly — Daily Planner & Habits application (the "App"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Use. If you do not agree, do not use the App.
2. Description of Service
The App provides a daily task planner, a habit tracker with a completion calendar, local reminders, and home-screen widgets. We may add, change, or suspend features without advance notice where permitted by law.
The App is provided "as is." We do not warrant that the App will be uninterrupted, error-free, or suitable for every device or your specific purpose.
3. Accounts
The App does not require you to create an account with us. There is no sign-up, no password, and no server-side profile. If the App later offers sign-in or server sync, any additional terms will be disclosed in the App or updated in this document.
4. Your Content and Local Storage
Your tasks, habits, notes, reminder times, and completion history belong to you and are stored only on your own device. We do not host, sync, back up, or receive a copy of them.
You are solely responsible for that data, including keeping your own backup. Uninstalling the App, clearing its data, resetting or losing your device, or a device failure will permanently delete it, and we cannot restore it for you because we never held a copy. See the Privacy Policy for details.
5. Reminders Are Not a Guaranteed Delivery Service
Reminders are scheduled as local notifications by your device's operating system. Their delivery depends on your device, its settings, permissions, battery-saving behaviour, and system state — all outside our control.
Do not rely on the App as the sole reminder for anything critical, including medication, medical appointments, legal or financial deadlines, or safety-related tasks. The App is a personal productivity tool and is not a medical, health, or professional advisory service.
6. Feedback and Reports You Send Us
If you use the in-app report form to send a bug report, feedback, a feature suggestion, or attached images, you confirm that you have the right to send that content and that it contains nothing unlawful, infringing, or confidential to someone else.
You grant us permission to use, store, and reproduce that content for the purpose of diagnosing and fixing issues and improving the App. Suggestions and feature ideas may be implemented without any obligation, compensation, or attribution to you.
You must not use the report form to submit abusive, unlawful, or deliberately misleading content, or to spam our systems. We may decline to act on, or delete, any submission.
7. Paid Features and In-App Purchases (IAP)
7.1 Payment channels
Some features are offered as paid plans (monthly, yearly, and lifetime) billed through:
- Apple App Store on iOS/iPadOS devices; or
- Google Play on Android devices
subject to each platform's terms and policies.
7.2 Auto-renewal and cancellation
Subscription plans renew automatically on a recurring basis (for example monthly or yearly), unless described otherwise at purchase. A lifetime purchase is a one-time payment and does not renew.
- iOS: Manage or cancel in Settings → [Your Name] → Subscriptions, per Apple's instructions.
- Android: Manage or cancel in the Play Store app under Payments & subscriptions, per Google's instructions.
To avoid being charged for the next period, you should cancel at least 24 hours before the current period ends (or as required by Apple/Google at the time).
7.3 Restoring purchases
Paid entitlements are tied to the Apple Account or Google Account used for the purchase, not to a Dayly account. Use Restore purchases in the App while signed in to that same store account to re-enable a plan on a new device or after reinstalling.
7.4 Pricing and taxes
Displayed prices may include or exclude taxes and fees depending on your region and Apple's or Google's policies. The amount charged is confirmed on the store's payment screen.
7.5 Refunds
Refund, return, or billing disputes for transactions on the App Store or Google Play are generally handled under Apple's or Google's policies, not directly by us, except where mandatory law provides otherwise.
8. Limited License
We grant you a personal, non-exclusive, non-transferable license to install and use the App only for lawful purposes and in accordance with these Terms.
You must not:
- Copy, modify, reverse engineer, decompile, or attempt to extract the App's source code, except where law prohibits such a waiver
- Rent, resell, sublicense, or commercially exploit the App
- Circumvent, disable, or tamper with paid-feature entitlement checks or the App's integrity and abuse-prevention mechanisms
- Use the App to violate law, third-party rights, or Apple/Google terms
- Interfere with or overload related systems, networks, or services
9. Intellectual Property
All content in the App (UI, text, graphics, logos, trademarks, audio, software, and overall look and feel) belongs to us or our licensors and is protected by intellectual property laws. No rights are granted except as expressly stated in Section 8.
10. Disclaimer and Limitation of Liability
To the maximum extent permitted by applicable law:
- We are not liable for any indirect, incidental, special, or consequential loss arising from use or inability to use the App.
- We are not liable for missed, delayed, or undelivered reminders, or for any consequence of relying on them (see Section 5).
- We do not guarantee error-free operation on all devices; local data loss (for example from uninstalling the App, clearing its data, or device failure) is outside our reasonable control.
Some jurisdictions do not allow certain limitations; in those cases, limitations apply only to the fullest extent lawful.
11. Termination
You may stop using the App at any time by uninstalling it. We may suspend or limit your access if you breach these Terms or if we must comply with legal or distributor requirements.
Termination does not affect obligations that already accrued (for example payments processed by Apple/Google under their policies).
12. Changes to These Terms
We may update these Terms. A new effective date will appear at the top of this document. Continued use of the App after the effective date may constitute acceptance of the revised Terms, where law allows.
